SECTION_01 Privacy Policy

1. Data Controller
QuantumLogicHarbor, ul. Ratuszowa 1, 62-300 Wrzesnia, Poland, is the data controller responsible for the processing of personal data collected through this website.

2. Personal Data We Collect

Your personal data is processed for the following purposes: responding to your inquiries, providing requested services, sending project-related communications, maintaining internal records, complying with legal obligations, and improving our website functionality.

We process your data based on: your explicit consent (Art. 6(1)(a) GDPR), the performance of a contract or pre-contractual measures (Art. 6(1)(b) GDPR), and our legitimate interest in improving services and responding to inquiries (Art. 6(1)(f) GDPR).

5. Data Retention
Personal data is retained for as long as necessary to fulfill the purposes for which it was collected. Inquiry data is retained for 24 months after the last communication. Contract-related data is retained for the duration of the contract plus 5 years as required by Polish law.

6. Data Sharing
We do not sell or rent personal data to third parties. Data may be shared with: hosting providers (data processing agreement in place), payment processors (Stripe), analytics providers, and law enforcement when legally required.

7. International Transfers
If data is transferred outside the EEA, we ensure adequate safeguards through Standard Contractual Clauses (SCCs) or adequacy decisions as required by GDPR Chapter V.

8. Your Rights
Under GDPR, you have the right to: access your data (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), object to processing (Art. 21), and withdraw consent at any time (Art. 7(3)). You have the right to lodge a complaint with the Polish Data Protection Authority (UODO) if you believe your data protection rights have been violated.

SECTION_03 Refund Policy

1. Service Delivery
QuantumLogicHarbor delivers digital services including web development, design, and consulting. All services are outlined in individual project agreements.

2. Refund Eligibility
Refunds are evaluated based on project milestones completed. If work has not commenced, a full refund may be issued within 14 days of payment. For partially completed work, refunds are prorated based on completed milestones as defined in the project agreement.

3. Non-Refundable Services
Domain registrations, third-party software licenses, hosting fees paid to external providers, and completed consulting hours are non-refundable.

4. Refund Process
To request a refund, contact [email protected] with your project reference number. Refund requests are processed within 10 business days of approval. Refunds are issued via the original payment method.

5. Dispute Resolution
In case of disputes, both parties agree to attempt resolution through good-faith negotiation before pursuing legal remedies. Governing law is that of the Republic of Poland.

SECTION_04 Terms of Service

1. Acceptance of Terms
By accessing or using the services of QuantumLogicHarbor, ul. Ratuszowa 1, 62-300 Wrzesnia, Poland, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Scope of Services
QuantumLogicHarbor provides digital studio services including but not limited to web development, UI/UX design, cloud infrastructure, SEO optimization, and consulting. Specific deliverables, timelines, and pricing are defined in individual project agreements.

3. Intellectual Property
Upon full payment, all intellectual property rights for deliverables are transferred to the client. QuantumLogicHarbor retains the right to display work in portfolio and marketing materials unless otherwise agreed in writing.

4. Payment Terms
Invoices are due as specified in the project agreement. Late payments incur a 2% monthly interest rate. Work may be paused if payment is overdue by more than 14 days.

5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the project. This obligation survives the termination of the agreement for a period of 3 years.

6. Limitation of Liability
QuantumLogicHarbor's total liability shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

7. Termination
Either party may terminate the agreement with 14 days written notice. In case of termination, the client pays for all work completed up to the termination date.

8. Governing Law
These terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved in the courts of competent jurisdiction in Poznan, Poland.
